COPYRIGHTS AND TRADEMARKS

As a result, you are entirely responsible for your use of Content, along with any other images, photos, artwork, graphics, text, or other content included within your Products. You agree and acknowledge that you shall not include in your Products any language, pictures, designs, trade-marks, service marks or any other type of copyrighted material belonging to any other individual or company, unless you have first received permission from the Owner of such copyrighted material.

You further agree and acknowledge that neither your Products violate the rights of others, nor does either your products make false statements about another individual or company, and that you have acquired the necessary license(s) and/or approval(s) to include third-party content in your Product(s).

When placing an order through this site, you agree and acknowledge that you have been authorized to place the order, and you hereby authorize Paknify.com as your Agent to produce the Products you have requested hereunder.

CUSTOMER CONTENT

You are entirely responsible for your usage of the Content as well as any combination of the Content with images, designs, graphics, text, or any other materials used in your products.
In addition to what I stated above, you acknowledge that you are prohibited from attaching text, graphics, designs, trademarks, service marks, or any other copyrighted materials produced by another entity to your products without having first received permission from such entities.

Additionally, you acknowledge that your products do not infringe upon any third-party rights, which include copyrights, trademarks, rights of publicity & privacy, and that you will not libel or defame any third party; and that you own or have the authority to incorporate into your products any third-party elements.

Upon entering an Order onto our site, you represent and warrant that you have all necessary approvals, grants and authorities to enter into the Order and to authorize paknify.com™ to manufacture the Products on your behalf.

Regardless of who creates them, whether you create them or someone else does, the Content (including but not limited to: information, data, text, images, photographs, graphics, message and all other forms of Content) shall always remain the sole responsibility of the individual(s) creating such Content. Accordingly, you are solely responsible for all Content you submit, upload, post or transmit using our Website.

You agree to comply with all applicable laws and regulations in regard to your behavior online and in relation to the Content. You agree not to use our Website to submit, post or otherwise communicate any Content, including but not limited to: obscene material; unlawful material; or Content violating the Intellectual Property Rights (as defined herein) of either paknify.com™ or any third party.

Due to our inability to monitor, review, or police the Content posted by our clients, we can give no assurance to you that any Content you see will be: correct; complete; accurate; reliable; or consistent with expectations. We hereby disclaim liability to you under any circumstance for any Content which you might deem offensive, indecent, or unpleasant.

Your failure to maintain the confidentiality of your Password and protect your Registered Account may subject you to personal financial loss and/or legal obligation for each and every transaction made using your Registered Account as well as each and every action performed therefrom.

Each time you (or anybody else with whom you have given access to your account) purchases a print item using your password, you provide paknify.com™ a License to utilize the content located on this web-site and/or the content contained within the printed product so that we can store or print the Design anywhere in the world and in perpetuity on a royalty-free basis (non-exclusively licensed) so that we can reproduce; modify; sub-license; publish; display; and create derivative works from.

You agree that paknify.com™ (and/or its agents) may remove, delete, or edit any Content submitted by you to this Site should we believe that such Content does not meet the requirements outlined in these Terms of Service or because we simply don’t like it.

DESIGN FILES

The low-resolution 72 DPI design files are all that we can provide. If you want us to send a high-resolution version of your design files, please send an email to info@paknify.com for a quotation.

CUSTOMER SUBMITTED ARTWORK

You need to submit your artwork designs and images in CMYK color format and a minimum of 300 dpi. paknify.com cannot guarantee there will be no changes in colors when converting from RGB to CMYK color modes.

We can also take no responsibility for printing distortions (pixilation) caused by poor quality customer provided artwork.

PROOFING & MATCHING

Beginning with a quote, “All print jobs are subject to customer approval of the final artwork and job spec sheet.” Once we receive your order through www.paknify.com, you will receive an e-mail with the final artwork proof and job specification sheet for you to review.

You are responsible for reviewing ALL of the information on the spec sheet (i.e., delivery dates AND/OR production speeds) and confirming that all of your requirements were properly documented on the spec sheet.

Paknify Co. Ltd. is responsible for any specifications and/or requirements that are contained outside those listed on the final spec sheet. In addition, you are responsible for reviewing the final artwork proof since Paknify Co. Ltd. will be released from any liabilities related to design and/or spelling errors if these are not pointed out to Paknify Co. Ltd. prior to submitting the artwork and specs to the Production Department for printing.

After the artwork and job specs have been approved, they will then be forwarded to the Production Department to be printed EXACTLY AS PROVIDED BY YOU. Paknify Co. Ltd. shall also release itself from liability related to color matching/ink density based upon screen proofs which have been approved by you.

Screen proofs depict the general layout of the project, ensure text is spelled correctly, verify images are the correct size/proportion and placement; however, they do NOT provide an accurate representation of color/density. If creating a duo-toned item, Paknify Co. Ltd. will attempt to reproduce the gradient density of each color used in the original proof. Paknify Co. Ltd. accepts no responsibility for the final appearance of a duo-toned product unless a color match proof is ordered.

Additionally, the application of lamination may affect how printed colors appear on the finished product.

MATERIALS

All packaging supplies are made with non-food-grade cardstock/paper at paknify.com. As such, it is your responsibility to inform us in writing of any food-grade packaging requirements that may need to be used prior to placing an order with Paknify LTD. for food-grade paper packaging supplies.

CUSTOMER IS RESPONSIBLE FOR PROOF AND LAYOUT APPROVAL PRIOR TO THE PRINTING.

Paknify Limited is NOT RESPONSIBLE for any errors in any item we produce, which we believe was caused by one or more of the following:

Graphics Orientation or Placement and Incorrect Font Usage

Spelling, Grammatical, and Punctuation Errors

Wrong Die cuts, slits, or Incorrect and Missing Folds

Finished Product Size

COLOR ACCURACY AND HARDCOPY PROOFS

We at paknify.com will try to replicate the colors as shown in your printed ready files when you send them to us. However, we can’t make sure that our colors are going to be identical to your ready files or their densities.

There are many reasons why this would occur; the most obvious reason is that the printing surface provided to us is physically different than what was used for your original image. In addition, we have to apply sufficient amounts of ink to both the areas of your images that need it so they appear as intended.

Also, keep in mind that we will guarantee that the reproduced colors on the items you order will be at least 90% like the final proof that you approved. Additionally, please know that paknify.com only guarantees color reproduction of your print-ready file if you opt to pay extra for a hard-copy proof.

Finally, please understand that paknify.com is not accountable for any discrepancies in color between the printed ready files you provide and the actual artwork and products depicted in those images.

INDEMNITY

You will be liable for all of paknify.com’s, its Directors’, Officers’ and Employees’ damages, whether resulting from claims made by third-party vendors who created content for the paknify.com website and posted such content here, or if individuals claim damages because they used materials obtained from this website.

• You violated your agreement as outlined in these Terms of Use.
• You are liable for any legal action, including a law suit, claims, or requests brought by paknify.com™ that may result from your addition of photographs, images, graphics, text or other materials to products you create through use of our website based application, when those photographs, images, graphics, text or other materials were not originally part of the standard site content we provided with our website application.

ORDER CANCELLATION

Cancellation of an order is available at any point in time during the production of your product. Paknify.com will do everything reasonably possible to cancel your order before it has been printed/ship.

Once your order has shipped, it cannot be cancelled. In addition to our standard return policy, there is a fee associated with cancelling your order throughout every step of the manufacturing process. A member of our customer service staff will let you know what that charge will be.

• Orders are placed online.
• Orders are reworked in our design department.
• Orders are sent to the press.
• Orders are collected by the shipping firm and shipped

Cancellation charges during Stage 1 include the initial processing payment of $15 + 5% of the total order value to account for bank fees and design department charges.
Cancellation charges in Stage 2 are a minimum of 20% of the total value of the order to provide for all costs incurred by the Design Department.

For orders that have reached Stage 3, should you wish to cancel your order, we will try our best to do so; however, we are unable to confirm that your order has not been completed. At this point, regardless of whether or when you decide to cancel your order from this point forward, you will be required to pay a minimum of 50% of the total order value for all applicable fees.

Once an Order has progressed through Stage 4 of the Ordering Process, no further cancellations are allowed.

DESIGN ORDERS

Once you’ve successfully placed an order using our website to complete an order; all orders (regardless of type) are final sale orders.

RETURNS AND REFUNDS

Since each one is a custom order, all sales are Final. We will reprint your design if we verify a mistake has been made in producing your order. There will be No Refunds or Credits.

RE-PRINTS

You are obligated to contact paknify.com within three (3) working days of receiving your package in order to report any damaged or defective merchandise, as well as missing item(s). paknify.com will accept no responsibility for damaged or defective products which we do not receive written notification of within three (3) days of your receipt of the merchandise.

To get a replacement for a defective product, you need to send back at least ninety-nine percent (99%) of the original merchandise you purchased, along with all packaging, etc., to paknify.com via mail at your expense. The returned merchandise needs to arrive within ten (10) days of the day you receive your initial order.

ORDER SHIPPING AND DELIVERY

paknify.com™ offers the following production options when placing an order: STANDARD (Shipping Time NOT GUARANTEED):

Typically dispatched within 10 to 14 business days after final proof approval.

Delivery time for Standard Service is not guaranteed.

PRIORITY – Guaranteed to dispatch within 8 business days:

Orders will be dispatched within 8 business days after final proof approval.

EXPRESS – Guaranteed to dispatch within 6 business days:

Free standard shipping is included within the mainland USA.

Orders will be dispatched within 6 business days after final proof approval

paknify.com™ typically processes orders and ships within 5-6 business days after an order is placed. If you do not submit your final approval for your order by 11:00 am est, we can’t promise that your order will be ready to ship before 7 days. We have a goal to print and ship all customer orders as fast as possible. The customer assumes all risk for any loss or damages incurred while producing, shipping, and delivering any customer order from paknify.com.

As a result of placing an order on paknify.com™, each buyer understands and agrees to assume the risk of delayed shipments due to machine failure, bad weather, delays caused by the carrier (third party), customs problems in foreign countries, and any other circumstances beyond paknify.com™’s ability to manage. The estimated time for delivery of goods to you is provided based on supplier information and historical trend information about shipping. paknify.com™ has no intention of delaying the delivery of any customer ordered items. As a rare occurrence, paknify.com™ may experience unforeseen technical difficulties in the form of computer malfunction, equipment failure, etc. In such cases where there are significant production and/or shipping disruptions, paknify.com™ may waive applicable Rush Charges/Expedite Fees for affected orders.

Due to unforeseen delays that may occur, all orders submitted to paknify.com™ are non-refundable/non-cancelable. Any shopper purchasing products on paknify.com™ may incur additional costs associated with customs duty & fees related to products being delivered to them. It is the purchaser’s obligation to clear all products through customs prior to receiving the product(s) at their international destination.

The customer must review their package for any obvious physical damage or missing items when reviewing against the list of items shown on the packing slip/invoice provided by the carrier upon receiving their package.

If the customer finds that damage has occurred to one or more items and/or an item(s) is missing, the customer should notify paknify.com as well as the carrier within 24 hours of finding damage/missing items in the shipment. The customer has three (3) business days from the day that the shipment arrives at the customer’s residence/business to submit a claim with paknify.com if they feel that damage/missing items occurred during transit.

Paknify.com is not liable for third-party shipping errors, omissions, or damaged packages. Any product is usually shipped with several free goodies. While this is generally the case, occasionally a shipment may contain fewer goods than were purchased. In general, an under/overage allowance in printing is allowed up to 5%.

Thus, if you require an exact quantity of each product, we recommend purchasing at least 10% above your desired quantity. There will also be additional costs for shipping/handling if a package needs to be re-shipped due to you entering the wrong address.

DISCLAIMER OF WARRANTY

Site and All Materials contained in this Site are provided ‘AS IS.’ We offer the site to you on an ‘as is’ basis without warranty of any kind, express or implied of any nature whatsoever. We attempt to provide you with continuous access to our Site; however, we make no representations or warranties regarding your ability to access or use this Site continuously, nor do we warrant that it will operate uninterrupted.

Any reference or link to third-party products or services (the “products”) referred to herein should be accurate when published and verified prior to purchase by you. These products and services are provided ‘as is,’ without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement.

LIMITATION OF LIABILITY

paknify.com and all of its affiliated parties (including but not limited to paknify.com’s licensees, providers, sellers, their officers, directors, workers, or representatives) will not be liable for any costs resulting from lost time; lost data; lost profits; etc.

This liability exists regardless of whether or not paknify.com was aware of the potential for such damage before, during, or after using this site, or if paknify.com fails to deliver the products or services which you have requested from paknify.com.
